RE: The marking of a luggage tag.

Dear Ms. Madison:

In your letter dated April 4, 1990, you requested a binding ruling on marking.

One sample was submitted. The article is a luggage tag that is removable and can be used on different pieces of luggage. It is made of leather, with a leather strap fastener and a flap that opens to view the identification of the owner. This sample is not properly marked.

Section 134.11 of the Customs Regulations requires that articles be marked legibly in a conspicuous place with the country of origin. This is so that the purchaser will be aware of the country of origin before purchase. You stated that the country of origin is printed on the name and address card that the consumer will pull out prior to using the tag. This marking is not visible to the prospective purchaser and therefore not marked as required by law. The outside tag must be marked. One acceptable marking would be in contrasting print as the words "Black Enterprise".

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
