RE: The tariff classification of woven and knit wearing apparel from Chile.

Dear Mr. Hasser:

In your letter received January 2, 1990, you requested a tariff classification ruling.

Four samples, a knit tennis shirt, woven tennis shorts, a knit warm up jersey and a woven warm up suit were submitted.

The knit tennis shirt for men is constructed from 100% cotton pique knit fabric containing more than 10 stitches per linear centimeter in each direction. The shirt has a rib knit spread collar; a two button placket; short sleeves with rib knit cuffs; and a hemmed waist with side slits and a tail. A tennis player logo is embroidered on the left chest.

The warm up jersey is a pullover garment for men of 100% finely knit cotton heavyweight fabric. The garment is oversized and has a rib knit round neckline; dropped shoulders; three-quarter length, hemmed sleeves; and a hemmed waist with side slits and a tail. A tennis player logo is embroidered on the left chest.

The woven tennis shorts will be either 50% cotton and 50% nylon or 60% cotton and 40% nylon. The shorts have an elasticized waist, a front fly opening with a zipper closure and a clasp and button closure on the waistband. It has a rear pocket and two side pockets.

As you requested, your samples are being returned to you. The applicable subheading for the tennis shirt will be 6105.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for men's knitted shirts of cotton. The rate of duty will be 21 percent ad valorem.

The applicable subheading for the warm up jersey will be 6110.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for men's other knitted cotton wearing apparel. The rate of duty will be 20.7 percent ad valorem.

The applicable subheading for the tennis shorts composed of 50% cotton and 50% nylon will be 6203.43.4030, Harmonized Tariff Schedule of the United States (HTS), which provides for men's woven shorts of synthetic fibers. The rate of duty will be 29.7% ad valorem.

The applicable subheading for the tennis shorts composed of 60% cotton and 40% nylon will be 6203.42.4050, Harmonized Tariff Schedule of the United States (HTS), which provides for men's woven shorts of cotton. The rate of duty will be 17.7 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the warm up suit. Your request for a classification ruling should include the construction and size specifications for similarly styled garments when designed for men exclusively, for women exclusively and when designed for wear by either men or women. Are the warm up suit or substantially similar garments sold to women's and girls' stores or departments as well as being sold to men's and boys' stores or departments. It would be helpful if you could submit brochures or other advertising material showing how the warm up suit is marketed.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
