RE: The tariff classification of gloves from Haiti.

Dear Ms. Diaz:

In your letter dated October 23, 1989, on behalf of North Hand Protection, you requested a tariff classification ruling.

Styles 86/3516L and 86/3522L are men's work gloves without fourchettes, made from cotton knit fabric that has been cut, coated with nitrile latex, and then sewn together.

Style 85/3721 XL is a men's without fourchettes, work glove where the palm, fingers, and thumb is made from cotton knit fabric that has been coated with nitrile rubber and sewn together. The back of the glove is made from cotton flannel covered with small plastic strips. The cut parts are then sewn together.

Styles 85/3729M and 85/3729L are men's work gloves without fourchettes, where the palm, fingers and thumb is made from cotton knit fabric that has been coated with rubber and sewn together. The back of the glove is made from cotton woven fabric.

Three work gloves were submitted without style numbers. Two are made of cowhide leather on the palms and woven cotton fabric on the back. The third glove is made of leather with a cotton lining. The essential character of the gloves are imparted by the leather components.

The applicable subheading for styles 86/3516L, 86/3522L, 85/3721 XL, 85/3729M and 85/3729 L will be 6116.10.1510, Harmonized Tariff Schedule of the United States (HTS), which provides for gloves, mittens and mitts, knitted, impregnated, coated or covered with plastics or rubber: Other: without fourchettes: Cut and sewn from pre-existing machine knit fabric that is impregnated, coated or covered with plastics or rubber: of vegetable fibers...containing over 50 percent by weight of plastics or rubber. The rate of duty will be 25 percent ad valorem.

The applicable subheading for the three leather gloves will be 4203.29.1800, Harmonized Tariff Schedule of the United States (HTS), which provides for gloves of cowhide leather: Other: Other... The rate of duty will be 14 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
