RE: The tariff classification of men's knit garments from Hong Kong.

Dear Mr. Kamnitz:

In your letter dated February 1, 1996, you requested a tariff classification ruling on behalf of Polo/Ralph Lauren Corporation.

Style 64-0114806 is a man's pullover constructed from 55 percent linen, 45 percent cotton, jersey knit fabric that measures 13 stitches per two centimeters counted in the horizontal direction. The garment features short, self-finished sleeves; a crew neckline; and a self-finished bottom with side slits.

Style 64-0114811 is a man's pullover constructed from 70 percent cotton, 20 percent linen, 10 percent silk, knit fabric that measures 10 stitches per linear centimeter counted in the horizontal direction. The garment features a partial front opening with two button closures; short sleeves with rib knit cuffs; a rib knit spread collar; and a rib knit waistband.

Style 64-0114809 is a man's sweater vest constructed from 75 percent linen, 25 percent cotton, knit fabric that measures 8 stitches per two centimeters counted in the horizontal direction. The garment features a V-neckline; oversized armholes; and a rib knit waistband. Rib knit edging finishes the neckline and the armhole openings.

The duty rate will be 6 percent ad valorem.

The applicable subheading for Style 64-0114811 will be 6110.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys'. The duty rate will be 19.9 percent ad valorem.

The applicable subheading for Style 64-0114809 will be 6110.90.9024, Harmonized Tariff Schedule of the United States (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: other: sweaters for men or boys: other: other: other. The duty rate will be 6 percent ad valorem.

Style 64-0114806 falls within textile category designation 838, Style 64-0114811 falls within textile category designation 338, and Style 64-0114809 falls within textile category designation 845. Based upon international textile trade agreements, products of Hong Kong are subject to a visa requirement and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.
