RE: The tariff classification of a man's knit and woven jacket from Taiwan.

Dear Ms. Brokaw:

In your letter, dated December 20, 1995, you requested a tariff classification ruling.

Style F64108, which you describe as your Equipment Hy-Velocity Jacket, is a men's jacket constructed from 62 percent nylon, 23 percent polyester, 15 percent spandex finely knit fabric and 100 percent nylon woven fabric. The garment features long sleeves with elastic cuffs; a baseball collar; a full front zippered opening; two side seam pockets below the waist; and a covered elastic, tunnel waistband. The front panels and the back yoke are lined with mesh knit fabric. There is a PVC logo on the upper left sleeve.

The woven portions of the garment consist of the major portion of the two front panels and the back yoke. The knit portions of the garment consist of the sleeves, the collar, the remainder of the back panel below the yoke, and the area on each front panel under the arms. Over 60 percent of the visible surface area of the garment is of knit construction.

As requested, your sample will be returned.

The essential character of the jacket is imparted by the knit sections. Consequently, the applicable subheading for Style F64108 will be 6101.30.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for: overcoats, .... windbreakers, and similar articles, knitted or crocheted, other than those of heading 6103: of man-made fibers: other: other: men's. The duty rate will be 29.6 percent ad valorem.

Style F64108 falls within textile category designation 634. Based upon international textile trade agreements, products of Taiwan are subject to visa requirements and quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
