RE: The tariff classification of Lady's Body Super/Biflex jumpsuit and a Men's Bike Body Shirt from Italy.

Dear Mr. Grob:

In your letter dated December 7, 1995, you requested a classification ruling.

The submitted samples are a Lady's Body Super/Biflex jumpsuit and a Men's Bike Body Shirt. The Lady's Body Super/Biflex jumpsuit consists of stretch knit man-made fiber fabric. It features a 3/4 length design and is sleeveless with a partial front zipper. There is a pad in the crotch for comfort. The Men's Bike Body Shirt is a pullover garment constructed from 100% polyester, double knit fabric which measures 11 stitches per 2 centimeters counted in the horizontal direction. The garment features a self-fabric neckband, short sleeves with self-fabric cuffs; a partial opening at the neck with a zipper closure, an embroidered logo on the left chest, and a hemmed bottom with a curved tail.

The applicable subheading for the Lady's Body Super/Biflex jumpsuit will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: Of man-made fibers: Other, Other: Women's or girls'. The duty rate will be 16 percent ad valorem.

The applicable subheading for the Men's Bike Body Shirt will be 6110.30.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of man-made fibers: Other: Other, Other, Other: Other: Men's and boys'. The duty rate will be 34 percent ad valorem.

The Lady's Body Super/Biflex jumpsuit falls within textile category designation 659 and the Men's Bike Body Shirt falls within textile designation 638. Based upon international textile trade agreements products of Italy are not subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
