RE: The tariff classification of a toddler's diaper cover and sundress from Hong Kong.

Dear Ms. Zink:

In your letter dated November 29, 1995, you requested a tariff classification ruling.

The submitted items, Style #62000506, are a toddler's cotton woven sundress with a matching diaper cover. The sundress features a scoop neck, and a V-shape back strap with a one button closure. The garment also has three functional buttons, which extend below the left arm and down the side, a gathered waist, and a hemmed bottom.

The diaper cover is constructed of cotton woven self fabric and features an elasticized waist, and elasticized leg openings.

You state in your letter that the garments will be imported in girl's sizes 2T-4T.

We are returning your samples as you requested.

The applicable subheading for the sundress will be 6204.42.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' dresses, of cotton, other, other, with two or more colors in the warp and/or the filling, girls'. The rate of duty will be 11.8% ad valorem. The applicable subheading for the diaper cover will be 6211.42.0081, Harmonized Tariff Scheduled of the United States (HTS), which provides for track suits, ski-suits and swimwear, other garments, of cotton, other. The rate of duty will be 8.5% ad valorem.

The sundress falls within textile category designation 336. Based upon textile trade agreements, products of Hong Kong are presently subject to quota restraints and visa requirements.

The diaper cover falls within textile category designation 359. Based upon textile trade agreements, products of Hong Kong are presently subject to quota restraints and visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
