RE: The tariff classification of a paper hat from Hong Kong

Dear Ms. Murphree:

In your letter dated August 14, 1995 you requested a tariff classification ruling on a paper hat from Hong Kong on behalf of The Gap. A ruling, NY 813832, was issued to you on the subject article on September 1, 1995. The aforementioned ruling is hereby modified by this ruling because of the addition of a breakout for hats of paper yarn in Supplement 1 to the Harmonized Tariff Schedules of the United States (1995) of June 5, 1995.

The submitted sample was an Old Nay Clothing Company'S style 440619, which was a women's crocheted hat stated to be made of coated 100% paper with a textile grosgrain trim around the brim. Under the HTSUSA, paper yarns are considered to be textile material and therefore the subject hat was considered to be a hat of textile yarns.

The applicable subheading for the crocheted paper hat, style 440619, will be 6505.90.9050, Harmonized Tariff Schedule of the United States (HTS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Other.... Other: Of paper yarn".. The rate of duty will be 21.9 cents per kilogram plus 8 percent ad valorem..

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
