RE: The tariff classification of "Ice Pak" ice cube maker from Venezuela.

Dear Mr. Portal:

In your letter dated April 7, 1995, on behalf of MV International Corporation, you requested a tariff classification ruling.

You have submitted a sample of an item you call "Ice-Pak". It is an item made entirely of plastic sheeting which can be filled with water in such a way that when frozen it produces 28 ice cubes. The plastic "Ice-Pak" is about 15 inches long and 6 1/2 inches wide. It functions as a disposable ice cube tray.

The applicable subheading for the plastic "Ice-Pak" ice cube maker will be 3924.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware kitchenware and other household articles and toilet articles of plastics, tableware and kitchenware, other. The rate of duty will be 3.4 percent ad valorem.

Articles classifiable under subheading 3924.10.5000, HTS, which are products of Venezuela are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
