RE: The tariff classification of men's knit garments from Hong Kong.

Dear Mr. Golden:

In your letter dated February 2, 1995, you requested a tariff classification ruling on behalf of Gotchaco Div. of Gotchaco International of Irvine, CA.

Style number SB1071 is a man's pair of pants constructed from 100 percent cotton, waffle knit fabric. The pants feature a fabric covered elastic waistband and rib knit cuffs at the ankles.

Style number SB1013 is a man's reversible padded sleeveless jacket. One side of the jacket is composed of a black color woven and wide-wale corduroy 100 percent cotton fabric. The other side is composed of a green color woven 100 percent nylon fabric portion on the front and back panels with an inset across the lower back panel which is composed of a black color woven 100 percent cotton fabric. The black color 100 percent cotton fabric insert measures approximately 8 inches in length by 25 1/2 inches in width. In a telephone conversation you stated that only the nylon fabric portion of the jacket has a 1000 mm PU coating and that the cotton insert portion across the back is uncoated. The garment has a non-woven polyester fill.

The coating is not "visible" as that term is defined in the tariff, therefore HTS 6210 does not apply.

The jacket has a full front opening secured by a reversible zipper pull closure. There are two chest pockets with flaps and two side seam pockets with zippers on the nylon fabric side. The cotton fabric side of the garment has a zippered left chest pocket.

As requested, your samples will be returned.

The applicable subheading for Style number SB1071 will be 6103.42.1020, Harmonized Tariff Schedule of the United States (HTS), which provides for: men's or boys'...trousers, knitted or crocheted: of cotton: trousers: men's. The duty rate will be 17 percent ad valorem.

The applicable subheading for Style number SB1013 will be 6201.93.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for: other men's anoraks, windbreakers and similar articles, of man-made fibers: other: padded, sleeveless jackets. The duty rate will be 16.8 percent ad valorem.

The pants fall within textile category designation 347 and the padded, sleeveless jacket falls within textile category designation 659. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have already been filed, this ruling should be brought to the attention of the Customs officer handling the transaction.
