RE: The tariff classification of a quilt shape and red hair doll with bloomers from China.

Dear Ms. Guarino:

In your letter dated January 23, 1995 you requested a classification ruling.

The submitted samples are a quilt shape which will be used as a wallhanging and a red hair doll with bloomers. The quilt shapes are made of 100 percent cotton woven fabric with a filler. They will be imported in various styles. The instant sample is shaped like a pig and the front portion is of a floral and plain patchwork checkered design while the back is plain. The shape is approximately 5 x 6 inches and has a hang loop at the top center.

The doll is also made of 100 percent cotton woven fabric with a filler. It has a head, red hair, arms, legs, feet, and a pair of removable bloomers. The fabric stuffed doll will be imported in various sizes 8, 10, 14, and 18 inches.

The applicable subheading for the quilt shapes will be 6304.92.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, or cotton. The duty rate will be 7.1 percent ad valorem.

The applicable subheading for the dolls, measuring 8" and 10" in height, will be 9502.10.0020, HTS, which provides for dills representing only human beings: whether or not dressed: not over 33 cm in height. The rate of duty will be free.

The applicable subheading for the dolls, measuring 14" and 18" in height will be 9502.10.0040, HTS, which provides for dolls representing only human beings and parts and accessories thereof: whether or not dressed: other: other. The rate of duty will be free.

The quilt shape fall within textile category designation 369. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
