RE: The tariff classification of a men's knit shirt from New Zealand.

Dear Mr. Wong:

In your letter dated December 1, 1994, you requested a tariff classification ruling. Style No. 3201-2 is a men's shirt constructed from 64 percent cotton, 36 percent nylon, jersey knit fabric which measures 11 stitches per linear centimeter in the horizontal direction and 16 stitches per linear centimeter in the vertical direction. The sample features long sleeves with rib knit cuffs; a left over right, partial front opening with three button closures; a self fabric spread collar with an underside of woven chambray fabric; a chambray fabric half-moon on the inside upper back panel; an embroidered logo on the left chest; and a hemmed bottom with side slits and a tail.

The applicable subheading for Style No. 3201-2 will be 6105.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for: men's or boys' shirts, knitted or crocheted: of cotton: men's. The duty rate will be 21 percent ad valorem. Style No. 3201-2 falls within textile category designation 338. Based upon international textile trade agreements, products of New Zealand are not subject to visa requirements or quota restraints.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have already been filed, this ruling should be brought to the attention of the Customs officer handling the transaction.
