RE: The tariff classification of four women's garments from Hong Kong.

Dear Ms. Terlizzi:

In your letter dated October 25, 1994, on behalf of Adrienne Vittadini, you requested a tariff classification ruling. Your samples are being returned as requested.

You submitted four samples. Style number P22733 is a woman's 100% cotton, cardigan constructed from knit and woven fabric. The cardigan features a V-neckline; long, hemmed sleeves; a full frontal opening with 4 button closures; and a hemmed bottom. The back panel, sleeves and two sections on the front panels are composed of knit terry fabric. The remaining fabric of the front two panels are composed of woven, ribbed and coarsely knit fabric sections. The outer surface of the terry knit fabric measures more than 9 stitches per 2 centimeters in the horizontal direction.

Style numbers P22732 and P22731 are two women's 100% cotton, pullovers constructed from knit and woven fabric. Style P22732 features a round neckline; long, hemmed sleeves; a two button, partial opening at the neck; 2 side slits; and a hemmed bottom. Style P22731 features a V-neckline; long, hemmed sleeves; 2 side slits; and a hemmed bottom. The back panels of each garment, the sleeves, and two sections of the front panels, are composed of terry knit fabric. The remaining fabric of the front panels are composed of woven, ribbed and coarsely knit fabric sections. The outer surface of the terry knit fabric, for each garment, measures more than 9 stitches per 2 centimeters in the horizontal direction.

Style P25631 is a woman's 100% cotton, pullover type sweater constructed from coarsely knit(CR) fabric and finely knit(FK) fabric. The sweater features a round neckline with a roll collar; short, hemmed sleeves; and a hemmed bottom. The sleeves and the bottom of the garment are composed of the FK fabric. The remaining fabric is composed of coarsely knit fabric. The outer surface of the CK fabric measures less than 9 stitches per 2 centimeters in the horizontal direction.

The essential character of styles P22733, P22732 and P22731 is imparted by the finely knit(FK) fabric. The essential character of style P25631 is imparted by the coarsely knit(CK) fabric; Harmonized Tariff Schedule of the United States (HTS), General Rules of Interpretation (GRI) Rule 3(b), noted.

The applicable subheading for styles P22733, P22732, and P22731 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters, pullovers...knitted: of cotton: other. The duty rate will be 20.7% ad valorem. The applicable HTS subheading for style P25631 will be 6110.20.2020, which provides for women's sweaters, knitted: of cotton: other. The duty rate will be 20.7% ad valorem.

Styles P22733, P22732 and P22731 fall within textile category designation 339. Style P25631 fall in category 345. Based upon international textile trade agreements products of Hong Kong are subject to visa requirements.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
