RE: The tariff classification of telehone message books, from the United Kingdom.

Dear Mr. Squicciarini:

In your letter dated September 26, 1994, on behalf of your client, Kleer Fax, Inc., you requested a tariff classification ruling.

Samples were submitted, which will be retained for reference. One is a finished article, while the other is an unfinished set of most of the components of that article. The product will be imported in both conditions.

The finished article is a spiral-bound book, 11 1/8" x 5 1/2", paperboard-bound, consisting of 400 "phone memos", in duplicate, 4 to a page. The book is titled, "Kleer-Fax Jotta-Call Telephone Message Book, Form K50-176", and contains on the front cover the printed information, "No Carbon Required. Permanent Record of Calls. 400 Duplicate Messages. 4 Messages Per Page."

The rear cover is printed with various useful information, such as telephone area codes, a three-year calendar, a time-zone map of the United States, and a list of important holidays, with their days and dates as occuring in a three-year period. The rear cover is designed to fold over the completed book, for permanent filing as a shelf-record.

In use, the message book will serve as a memorandum of incoming calls, recording "To", "From", "Date", etc., and "Message". The original, white, copy will then be detached and given to the intended recipient of the phone call, with the duplicate, yellow, copy remaining in the spiral binding as a permanent record of the transaction.

The applicable subheading for the "Jotta-Call Telephone Message Book", imported in either a finished (bound) or unfinished (unbound) condition, will be 4820.10.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for: Memorandum pads, letter pads and similar articles, of paper or paperboard. The rate of duty will be 4 percent.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
