RE: The tariff classification of Idler Rollers from Mexico

Dear Mr. Vyborny:

In your letter received by us on September 8, 1994, on behalf of your client, Osborn Manufacturing, you requested a tariff classification ruling.

The items involved in this request consist of a line of idler-rollers, sold under the trade name of "Load Runners". These units, which appear to have a wide range of applications, are comprised of outer steel tires, or runners, which contain either two complete tapered roller bearings or two deep groove radial ball bearings. Idler rollers come with and without pre-mounted threaded studs. Those without studs are used for heavy, thru-shaft applications. The outer tires can come in either plain, plain with an eccentric bushing, flanged, flanged with an eccentric bushing, v-grooved, v-grooved with eccentric bushing, or u-grooved. The different styles are designed to meet different applications in which load, guiding, and stability are important factors.

Your submission showed a wide range of uses for these rollers, ranging from conveyors and handling systems in assembly plants, to molding and core making systems for handling flasks in foundries. You also showed applications in such diverse fields as airport jetways, agricultural equipment, and Aerospace. In as far as the U-Grooved rollers are concerned, your literature indicated that they are most often used for wire guides and idler pulleys. Since pulleys have a specific provision in the Harmonized Tariff Schedules, and we do not have sufficient information to determine what the principal use of the U-Groove rollers will be, we are unable to offer you a tariff classification for them at this time. As to the other types of rollers, we have determined that they would not be considered ball or roller bearings, but rather, industrial components containing bearings.

The applicable subheading for the Load Runner idler-rollers (except for the U-Grooved) will be 8485.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for machinery parts, not containing electrical connectors...or other electrical features, and not specified or included elsewhere in chapter 84, other. The rate of duty will be 5.7 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
