RE: The tariff classification of fan coil units from Turkey.

Dear Mr. Demirkan:

In your letter dated August 15, 1994 you requested a tariff classification ruling.

The TESA fan coil units consist primarily of coils, fans, motors and valve assembly packages. They come in five sizes and four types, floor mounted, ceiling mounted, concealed floor mounted and concealed ceiling mounted. The fans are forward curved, multi-blade, dual suction type. The motors have six variable speed settings. The coils are copper tube, aluminum fin type. Condensate from the coil is collected in a galvanized steel, insulated condensate pan and is directed towards a plastic drip pan.

The applicable subheading for the TESA fan coil units will be 8415.83.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for other air conditioning machines not incorporating a refrigerating unit. The duty rate will be 2.2 percent.

Articles classifiable under subheading 8415.83.0090, HTS, which are products of Turkey are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
