RE: The tariff classification of woven upholstery fabric from Germany.

Dear Ms. Foeller:

In your letter dated July 12, 1994, you requested a tariff classification ruling.

You have submitted a sample of jacquard woven fabric that is identified as style BB Wall Street. This fabric is composed of 48% cotton, 42% wool and 10% staple nylon. It is manufactured with yarns of different colors. Weighing 437 g/m2, this textile product will be imported in 137 centimeter widths.

The applicable subheading for the woven fabric, identified as style BB Wall Street will be 5212.24.1020 Harmonized Tariff Schedule of the United States (HTS), which provides for other woven fabrics of cotton, weighing more than 200 g/m2, of yarns of different colors, containing 36 percent or more by weight of wool or fine animal hair. The rate of duty will be 33 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.

Sincerely,

Jean F. Maguire
