RE: The marking of watches.

Dear Mr. Ho:

In your letter dated August 7, 1996, you requested a ruling on the marking of watches imported by your company.

You indicate that your company is an importer of watches and owns the registered trademark of "Pierre Nicol". You inquire whether the marking "U S A" on the dials would be acceptable, although the watches are assembled in China with Japanese movements.

Marking the dials of the watches with "U S A" has nothing to do with the actual country of origin and is misleading to the consumer. Therefore, such marking is not acceptable.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
