RE: The country of origin marking requirements for various "Screwpull" wine accessories from Ireland.

Dear Mr. Jones:

In your letter dated August 1, 1996, you requested a ruling on the country of origin marking requirements for "Screwpull" wine accessories.

The parts for the assembly of various "Screwpull" wine accessories will be imported into Ireland from France, England, Switzerland, China, Taiwan, Indonesia and some made domestically in Ireland. These parts will be assembled into complete articles in Ireland and then shipped to the United States. These accessories are actually corkscrews which will be sold and marketed in a sealed package.

Section 304 of the Tariff Act of 1930, as amended (19 U.S.C. 1304) provides in general that any article of foreign origin (or its container) imported into the United States must be marked conspicuously, indelibly, legibly and as permanently as the nature of the article will permit in such manner as to indicate the country of origin to the ultimate purchaser in the United States.

Assembled articles are considered products of the country of assembly for the purposes of the country of origin marking requirements of section 304, Tariff Act of 1930, as amended (19 U.S.C. 1304). The various components may be disclosed by using a legend such as "Assembled in Ireland from material of foreign origin," or a similar phrase. In addition, the outer shipping containers must be marked in the same fashion.

The following would apply to your country of origin marking requirement(s): 1) "Assembled in Ireland of parts from various countries" on the sealed package used for marketing.

2) The outer shipping containers are required to be marked in the same fashion as described in 1 above.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
