RE: The tariff classification of Skibobs from Austria.

Dear Mr. Hollenbeck:

In your letter dated June 19, 1996, you requested a tariff classification ruling.

The subject merchandise is identified as a Skibob and will be marketed under the brand name "Snowbike." The Skibob is a non-motorized surface skimming device and consists of a metal frame and handlebars, rubber seat, two long skis which attach to the frame front and back and two foot skis which the rider wears to stabilize and to brake. It is said that the principle use of the Skibob in the United States will be the transporting of persons on ski-slopes primarily, we infer, for sport recreation. The applicable subheading for the Skibob will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for "Articles and equipment for general physical exercise, gymnastics, athletics, other sports...not specified or included elsewhere in this chapter;...Other: Other." The rate of duty will be 4.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Tom McKenna at 212-466-5475.

Sincerely,

Roger J. Silvestri
Director
