RE: The tariff classification of EC9206A, EC9210A, EC9217A, EC6246A and Surflo S3712 from Canada

Dear Mr. Cosman:

In your letter dated May 8, 1996, you requested a tariff classification ruling.

The samples submitted are as follows:

1. EC9206A is a corrosion inhibitor product consisting of xylene, methanol, isopropanol, TOFA anhydride/amidoamine salts, alky pyridine mixture, ethoxylated castor oil and ethyl benzene. It is used to inhibit internal corrosion in oil and gas wells by forming a film on the surface of the casing, tubing, and pump parts.

2. EC9210A is a corrosion inhibitor product consisting of methanol, isopropanol, TOFA anhydride/amidoamine salts, alkyl pyradine hydrochlorides, benzyl chloride quaternary salt, quaternary ammonium chloride salt, diethylamine and an ethoxylated alkyl amine. It is used to inhibit internal corrosion in oil and gas pipelines by forming a film on the internal surface of the pipe.

3. EC9217A is a corrosion inhibitor product consisting of isopropanol, triethanolamine, substituted morpholine, diethanolamine, ammonium bisulfite and water. It is used to inhibit internal corrosion in the annulus of oil and gas wells by forming a film on the internal surface of the pipe.

4. EC6246A is a scale inhibitor product consisting of methanol, alkylamine phosphonate, ammonium chloride and water. It is used by oil and gas producers to prevent mineral scale deposition in oil and gas equipment.

5. Surflo S3712 is a hydrate control chemical product consisting of methanol, ethoxylated nonyl phenol and water. It is designed and used to inhibit the formation of hydrates in oil and gas production equipment.

The applicable subheading for the EC9217A and Surflo S3712 will be 3402.90.3000, HTS, which provides for organic surface-active agents (other than soap); surface-active preparations, washing preparations (including auxiliary washing preparations) and cleaning preparations, whether or not containing soap, other than those of heading 3401 (con): Other: Other: Containing any aromatic or modified aromatic surface-active agent. The general rate of duty will be 6.2 percent ad valorem.

The applicable subheading for the EC9206A and EC9210A, will be 3402.90.5050, HTS, which provides for organic surface-active agents (other than soap); surface-active preparations, washing preparations (including auxiliary washing preparations) and cleaning preparations, whether or not containing soap, other than those of heading 3401 (con): Other: Other: Other: Other. The general rate of duty will be 3.7 percent ad valorem.

The applicable subheading for the EC6246A will be 3824.90.9050, HTS, which provides for prepared binder for foundry molds or cores; chemical products and preparations of the chemical or allied industries (including those consisting of mixtures of natural products), not elsewhere specified or included; residual products of the chemical or allied industries, not elsewhere specified or included (con): Other: Other: Other: Other: Other: Other. The general rate of duty will be 5 percent ad valorem.

Goods that originate in Canada may be eligible for a special rate of duty, under the North American Free Trade Agreement (NAFTA). However, there is insufficient information at this time to determine whether these goods qualify under NAFTA. Please see General Note 12 of the HTS.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
