RE: The tariff classification of ribbons and trimmings from Taiwan

Dear Ms. Calhoun:

In your letter dated April 24, 1994 (presumed to be 1996) you requested a tariff classification ruling on behalf of XYZ Imports International.

You have submitted five samples of 2-inch wide decorative ribbons or trimmings. The samples all have ends that are cut and not hemmed. The edges have been made fast by overlock stitching, enclosing lengthwise wires along each edge to add stiffness. Sample #6800857 is a white sheer woven man-made fiber ribbon with an embroidered design of metallized man-made fiber yarn and opalescent edging. Sample #6800788 is a burgundy woven flocked polyester ribbon backed with gold woven fabric (metallized man-made fiber). This sample has molded-on-thread plastic gold beads applied to the edges of the ribbon during the hemming process (the beads are not embroidered to the fabric's edges). Sample #6800881 is a gold (metallized man-made fiber) openwork warp knit mesh ribbon with gold edging. Sample #6800836 is a white and gold (metallized filament) man-made fiber diamond-patterned lace ribbon of openwork warp knit construction, with gold edging. Sample #6800839 is a white and gold (metallized filament) man-made fiber flower-patterned lace ribbon of openwork warp knit construction, with gold edging.

The applicable subheading for sample #6800857 will be 5810.92.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for embroidery in the piece...; other embroidery; of man-made fibers; other; other; other. The rate of duty will be 8.4% ad valorem.

The applicable subheading for sample #6800788 will be 5808.90.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for ...ornamental trimmings in the piece, without embroidery, other than knitted or crocheted...; other; of man-made fibers. The rate of duty will be 7% ad valorem.

The applicable subheading for samples #6800881, #6800836, and #6800839 will be 6002.20.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics; other, of a width not exceeding 30 cm; open-work fabrics, warp knit. The rate of duty will be 15.6% ad valorem.

All five samples fall within textile category designation 229. Based upon international textile trade agreements, products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
