RE: The tariff classification of a table runner and a quilt from India

Dear Ms. Amundson:

In your letter dated April 23, 1996, received by this office on April 30, 1996, you requested a classification ruling.

The submitted samples consist of a table runner and an infant sized quilt. The "Cat and Bird Tablerunner", item number 18950-4, is made from 100 percent cotton woven fabric. It measures approximately 10.5 x 43 inches and features a cat and bird design created by pieced fabrics and embroidery. The "Cat and Bird Lap Quilt", item number 18949-8, is made from 100 percent cotton woven fabrics and is stuffed with a polyester filler. The quilt measures approximately 37 x 48 inches and features a bird and cat design created by pieced fabric, applique work and embroidery.

The applicable subheading for the table runner will be 6302.51.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: other table linen: of cotton: other. The duty rate will be 7 percent ad valorem.

The applicable subheading for the infant sized quilt will be 9404.90.8505, Harmonized Tariff Schedule of the United States (HTS), which provides for mattress supports; articles of bedding and similar furnishing (for example, mattresses, quilts, eiderdowns, cushions, pouffes and pillows) fitted with springs or stuffed or internally fitted with any material or of cellular rubber or plastics, whether or not covered: other: other: other: quilts, eiderdowns, comforters and similar articles... with an outer shell of cotton. The duty rate will be 14.2 percent ad valorem.

The table runner falls within textile category designation 369 while the quilt falls within textile category designation 362. Based upon international textile trade agreements products of India are subject to the requirement of a visa. Products of India in textile category designation 362 are also subject to quota restrictions.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
