RE: The tariff classification of shoulder bags, a cigarette tote, a checkbook wallet and a wallet from China

Dear Ms Duffy:

In your letter dated March 25, 1996 you requested a classification ruling.

You have submitted five samples identified as styles BBBR387, BBBR388, BBBR389, BBBR390 and BBBR393. Each sample is manufactured of a fabric backed cellular plastic sheeting which has a man-made textile fiber flocking on the exterior surface. The plastic sheeting has been embossed to simulate the warp and weft of a textile fabric and the flocking fills the interstices created by the flocking, imparting a more authentic textile appearance and feel. The flocking constitutes a significant portion of the exterior surface of each article. Styles BBBR389, BBBR390 and BBBR393 are ornamented with a metal ornament which bears the tradename "VR Classics". Each sample contains printed inserts which read " Copper Creek by Bag Bazaar". Style BBBR388 has been destroyed in examination and cannot be returned. The remaining samples are being returned as requested.

Styles BBBR387 and BBBR388 are shoulder bags designed to contain the personal accessories commonly carried by a girl or lady in a purse or pocketbook.

Style BBBR390 is a checkbook wallet which is threefold and closes by means of a snap closure. The interior has a bill-fold section, five credit card slots, an identification card window, and a checkbook cover. The exterior has zippered pocket on the back and an open pocket under the front flap. The wallet is not designed to contain articles commonly found in a purse or pocketbook.

Style BBBR389 is a small wallet with zippered purse. The wallet is bi-fold with a snap closure. The interior has a bill-fold, three credit card slots and an identification card window. There is a small open pocket on the front.

Style BBBR393 is a smoke tote with coin purse. There is a zippered section suitable to contain currency.

The applicable subheading for styles BBBR387 and BBBR388 will be 4202.22.8050, Harmonized Tariff System of the United States, Annotated (HTS), which provides for handbags, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 19.5 percent ad valorem.

The applicable subheading for styles BBBR389, BBBR390 and BBBR393 will be 4202.32.9550, HTS, which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of textile materials, other , other, of man-made textile fibers.

Tariff numbers 4202.22.8050 and 4202.32.9550 fall within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
