RE: The country of origin marking requirements for pole pruners from Taiwan and Japan.

Dear Ms. Castellanos:

In your letter dated March 14, 1996, you requested a ruling on the country of origin marking requirements for 6 pole pruners. Your submitted samples will be returned to you as requested. They are described as follows:
a) TP 6811 - Pole Pruner - 12' Taiwan/Japan b) TP 3714 - Pole Pruner Taiwan/Japan c) TP 3811 - Pole Pruner - 10' Taiwan/Japan d) TP 3841 - Pole Pruner - 12' Taiwan/Japan e) TP 3851 - Pole Pruner - 12' Taiwan/Japan f) TP 6821 - Pole Pruner - 14' Taiwan/Japan

The requirements for marking of these items were explained in detail in NY ruling letters 809420 and 809421 which were issued to you, as you have cited. At that time, we cited that some of your items were not legally marked. Your re-submitted samples are still not legally marked as to their country of origin. The card which is sold with the tool is legally marked. However, each of the pole pruners is packed in such a way, that the country of origin marking on these cards is obscured and not readable by the ultimate purchaser.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
