RE: The tariff classification of recorded media from Ireland.

Dear Mr. Maxwell:

In your letter dated March 1, 1996, you requested a tariff classification ruling on behalf of the Microsoft Corporation.

This issue concerns the importation of a CD-ROM laser disc and a 3.5 inch diskette. Both items will have software recorded on the media in Ireland. Your letter states that these items will not be sold at retail.

The applicable subheading for the CD-ROM will be 8524.31.0070, Harmonized Tariff Schedules of the United States (HTS), which provides for records, tapes and other recorded media; discs for laser reading systems: for reproducing phenomena other than sound or image; other. The rate of duty will be 5.8 cents per square meter of recording surface.

The applicable subheading for the 3.5 inch diskette will be 8524.91.0070, Harmonized Tariff Schedules of the United States (HTS), which provides for records, tapes, and other recorded media; other magnetic tapes: other: for reproducing phenomena other than sound or image; other. The rate of duty will be 5.8 cents per square meter of recording surface.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
