RE: The tariff classification of tufted rugs from India.

Dear Ms. Abustan:

In your letter dated January 23, 1996 you requested a tariff classification ruling.

The submitted samples identified, as Nautilus and Kashmir, are tufted rugs. Both rugs are constructed of cotton yarns which have been tufted into a cotton woven fabric base. They measures approximately 22 x 36 inches exclusive of a 2 inch fringe. The fringe on style Kashmir is formed by the warp yarns in the base fabric while the fringe on style Nautilus is a sewn on addition. These rugs have a non-tufted border area. The non-tufted border area in the Nautilus style is printed with a shell design. The non-tufted border area in the Kashmir has a floral chainstitch design.

The applicable subheading for the rugs will be 5703.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for carpets and other textile floor coverings, tufted whether or not made up: of other textile materials. The rate of duty is 6.8 percent ad valorem.

Presently, floor coverings classified in subheading 5703.90.0000, HTS, are not assigned a textile category designation.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
