RE: The tariff classification of girls' wearing apparel from Macau

Dear Ms. Zink:

In your letter dated January 17, 1996 you requested a tariff classification ruling on four garments which are all made from a fine knit fleece fabric which you indicate is 100% polyester. You also have indicated that all items will be imported in little girls' sizes XS(4-5), S(6-6X) and big girls' sizes M(7-8), L(10-12), XL(14) and XXL(16).

The first sample, identified as both Style 64092725 and 64093275, is a one-piece short leg playsuit. It is sleeveless with a partial front right over left opening secured by five plastic buttons. The garment has a scoop neckline in the front and all edges are hemmed.

The second sample, identified as both Style 64092215 and 64093215, is a long sleeve, collarless cardigan with a full right over left front opening secured by five snaps. All edges are finished with a band of contrasting color rib knit capping.

The third sample, identified as both Style 64092124 and 64093124, is a long sleeve cardigan with a full right over left front opening secured by five plastic buttons. This garment has a shirt type collar. There are side seam slits at the bottom and the bottom and sleeves are hemmed. The collar is finished with overlock stitching.

The fourth sample, identified as both Style 64092212 and 64093212 is a vest with a deep v-neck opening and deep armholes. This garment has a full right over left front opening secured by five plastic buttons. There is a patch pocket on each front near the waist and all edges are hemmed.

The applicable subheading for the one-piece playsuit will be 6114.30.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of man-made fibers: Other: Sunsuits, washsuits, one-piece playsuits and similar apparel: Women's or girls'. The rate of duty will be 15.9 percent ad valorem.

The applicable subheading for both of the cardigans will be 6110.30.3055, HTS, which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Other: Women's or girls'. The rate of duty will be 33.8 percent ad valorem.

The applicable subheading for the vest will be 6110.30.3035, HTS, which provides as above, but for Vests, other than sweater vests: Women's or girls'. The rate of duty will be 33.8 percent ad valorem.

The one-piece playsuit falls within textile category designation 237, the cardigans within category 639 and the vest within category 659. Based upon international textile trade agreements products of Macau are subject to the requirement of a visa. The cardigans are also subject to quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

In accordance with your request your samples will be returned to you under separate cover.

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
