RE: The tariff classification of Objectives and Eyepieces from China

Dear Ms. Thomas:

In your letter dated January 10, 1996 you requested a tariff classification ruling.

The optical components are designed for use with medical diagnostic devices called Focometers. The imported items are the objective lens and the eyepiece for the Focometer. Both the objective lenses and the eyepieces are optical elements in a mounting. Samples were provided to this office and are being returned as you requested.

The applicable subheading for the objective lens in a mounting will be 9002.19.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for lenses, prisms, mirrors and other optical elements, of any material, mounted, being parts of or fittings for instruments and apparatus: objective lenses and parts and accessories thereof: other. The rate of duty will be 4.9 percent ad valorem.

The applicable subheading for the eyepiece in a mounting will be 9002.90.9500, Harmonized Tariff Schedule of the United States (HTS), which provides for lenses, prisms, mirrors and other optical elements, of any material, mounted, being parts of or fittings for instruments or apparatus: other: other: other. The rate of duty will be 6.2 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
