RE: The tariff classification of women's dresses from China

Dear Mr. O'Neill:

In your letter dated December 28, 1995, you requested a classification ruling on behalf of Line Up For Sport. The samples submitted with your request will be returned to you under separate cover.

Style LT-1234 is a dress constructed from 100 percent rayon woven fabric. The sleeveless dress features a scoop neckline, 2 inch wide shoulder straps and a back zipper closure. The dress extends to mid-thigh. Style LT-1435 is identicla in style to LT-1234 and is constructed in 55 percent linen\45 percent cotton woven fabric.

The applicable subheading for the style LT-1234 will be 6204.44.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets and blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of artificial fibers: other: other: women's. The duty rate will be 16.8 percent ad valorem.

The applicable subheading for style LT-1435 will be 6204.49.5060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets and blazers, dresses, skirts, divided skirts, trouserts, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of other textile materials: other: other: other. The duty rate will be 7.4 percent ad valorem.

Style LT-1234 falls within textile category designation 636 and style LT-1435 falls within textile category 836. Based upon international textile trade agreements products of China are subject to a visa requirement and quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
