RE: The tariff classification of a Z-Drive Remote Control System from Norway

Dear Ms. Evans:

In your letter dated November 13, 1995, on behalf of Ulstein Maritime, Ltd., you requested a tariff classification ruling.

The Z-Drive Remote Control System is used in conjunction with a Z-drive propulsion unit. The propulsion unit is an integrated combination consisting of an internal combustion engine, drive unit and propeller, and is used in commercial vessels. This drive unit performs both propulsion and steering functions, and also allows for the rotation of the propeller at a full 360 degree angle. The remote control unit, located on the bridge, is a solid state electronic system which regulates the steering, clutch and engine speed through a single control, known as the "Combilever".

The applicable subheading for the Z-Drive Remote Control System will be 8537.10.9070, Harmonized Tariff Schedule of the United States (HTS), which provides for other boards, panels ..., equipped with two or more apparatus of heading 8535 or 8536, for the control or distribution of electricity, for a voltage not exceeding 1000 V. The rate of duty will be 4.8 percent ad valorem. The rate of duty for merchandise entered for consumption, or withdrawn from warehouse for consumption, on or after January 1, 1996 will be 4.3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
