RE: The tariff classification of baskets of bamboo strip and baskets of rattan wickerwork from China

Dear Ms. Elliott:

In your letter dated November 6, 1995, on behalf of your client, United Pacific Imports, you requested a tariff classification ruling.

The ruling was requested on four styles of baskets, samples of which were submitted. Style No. UP-6151 is a small basket made of interwoven strips of bamboo. It has a metal handle shaped in the outline of a bunny. Style No. 073226 is a small square basket made of interwoven strips of bamboo. It is decorated with wood appliques on the sides. Style No. 07-5065 is an upright heart shaped basket made of interwoven rattan rods approximately 2 mm in diameter. The handle, the feet and the frame of the basket are made of metal. In addition, it has a resin applique on one side. Style No. UP-1212 is an oval shaped basket made of interwoven rods of rattan. It has wood appliques forming part of the sides.

The applicable subheading for the baskets made of interwoven strips of bamboo (Style Nos. UP-6151 and 073226) will be 4602.10.0900, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for other baskets and bags, whether or not lined; of bamboo, other (than wickerwork). The rate of duty will be 10 percent ad valorem.

The applicable subheading for the baskets made of interwoven rods of rattan (Style Nos. 07-5065 and UP-1212) will be 4602.10.1400, HTSUSA, which provides for other baskets and bags, whether or not lined; of rattan or of palm leaf, wickerwork. The rate of duty will be Free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
