RE: The tariff classification of candle lamps from Austria.

Dear Mr. Mindling:

In your letter dated October 12, 1995, you requested a tariff classification ruling.

The merchandise at issue, based on the literature submitted, consists of candle lamps made-up of variegated base units, composed of either brass or ceramic, that are designed to hold a fuel canister and support a glass globe. It is stated that the fuel canister, utilized in lieu of wax candles, is non- pressurized and possesses an adjustable wick. It is noted that the essential character of these lamps are imparted by their brass and ceramic base units.

The applicable subheading for the brass candle lamps will be 9405.50.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for non-electrical lamps and lighting fittings of brass. The rate of duty will be 5.7 percent ad valorem.

The applicable subheading for the ceramic candle lamps will be 9405.50.4000, HTS, which provides for other non-electrical lamps and lighting fittings. The rate of duty will be 7.3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
