RE: The tariff classification of automotive lights, signaling equipment and their parts and accessories from Italy

Dear Ms. Helfenbein:

In your letter dated August 7, 1995 you requested a tariff classification ruling.

You state that the purpose of all the items submitted is to provide High Beam, Low Beam, Flood, Fog, Stop and Tail light and Turn signaling functions on mining equipment (e.g., dump trucks, excavators, loaders, crawlers, etc.).

The first items are seven models of circular, glass lenses (models #8B501, 8B502, 8B503, 8B504, 8B505, 8B506 and 8B507) of varying color, each having a diameter of 17".

The applicable subheading for the glass lenses will be 7014.00.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for Signaling glassware and optical elements of glass . . . , not optically worked: Optical elements: Other. The rate of duty will be 9% ad valorem.

The second group of items are seven plastic lenses (models #8B521, 8B522, 8B523, 8B524, 8B525, 8B526 and 8B527) of varying colors, each measuring 17" in diameter.

The applicable subheading for the plastic lenses will be 9001.90.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for . . . lenses . . . of any material, unmounted, other than such elements of glass not optically worked: Other: Lenses. The rate of duty will be 4.9% ad valorem. The next item is a Lo-Beam lamp (Model #8B522 27) with a black, hard plastic shell and a 17" diameter circular, clear plastic lens.

The applicable subheading for the Lo-Beam lamp will be 8512.20.2040, Harmonized Tariff Schedule of the United States (HTS), which provides for Electrical lighting or signaling equipment . . . of a kind used for . . . motor vehicles . . . : Other lighting or visual signaling equipment: Lighting equipment: For vehicles . . . . The rate of duty will be Free.

Next, are a light beige, hard plastic lamp shell (Item #8C503) measuring 18" in diameter; a silver, hard plastic reflector shell (Item #8C501) measuring 18" in diameter; a 3 3/8" , gray, metal single-wire clip (Item #8E001); a 3 «", black, soft plastic gasket (Item #8N005) and a 9 «" black, soft rubber gasket (Item #8N501).

The applicable subheading for the lamp shell, reflector shell, single-wire clip and both gaskets will be 8512.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Electrical lighting or signaling equipment . . . for . . . motor vehicles; parts thereof: Parts: Of lighting equipment: Other. The rate of duty will be Free.

The last item is a black, steel, 1 3/8" long tapping screw (Item #8M007).

The applicable subheading for the tapping screw will be 7318.14.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for Screws . . . : Threaded articles: Self-tapping screws: Having shanks or threads with a diameter of less than 6 mm. The rate of duty will be 6.2% ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
