RE: The tariff classification of a joystick from China.

Dear Mr. Heck:

In your letter dated October 23, 1995, on behalf of Vivitar Corporation, you requested a tariff classification ruling.

The merchandise under consideration involves a "Wireless Joystick" which is an infra-red unit for use with IBM PC compatible computers. This device consists of a docking station which functions as a receiver, and the wireless joystick which operates as a transmitter-controller.

The docking station is connected to the joystick port of the computer by a cable with a 15-pin connection. The battery operated wireless joystick rests in the docking station when not in use, and is a wireless hand held unit when in use. The joystick-controller communicates with the computer by trans- mitting infra-red signals to the docking station which is connected to the computer. The design of this unit possesses both analog sensing for 3D, driving, fight and space simulations, and digital sensing for arcade, action and digital games. This device will allow the user to sit, stand or even walk around the room while playing computer games.

The docking station and the joystick appears to meet the requirements of GRI-3(b) since it is imported, sold and marketed as a retail set. The essential character of this set is exemplified by the wireless joystick. This device also meets the definition of an input "unit" as per Legal Note 5(B) to Chapter 84 of the HTS.

The applicable subheading for this "Wireless Joystick" unit which incorporates the docking station and joystick will be 8471.92.8880, Harmonized Tariff Schedule of the United States (HTS), which provides for other input units. The rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
