RE: The tariff classification of an expandable duffel style travel bag from Korea and/or Vietnam.

Dear Mr. Craig:

In your letter dated October 16, 1995, on behalf of Lucas GmbH, you requested a classification ruling for an expandable duffel style travel bag.

You have submitted a sample of an expandable duffel style travel bag designed to be carried by hand or on the shoulder. The bag is composed of an exterior surface of nylon woven fabric with a textile inner lining. The item features a large top drawstring compartment, an exterior full-width zippered compartment, and a textile carrying handle, in addition to a textile shoulder strap. There is a textile zipper around the entire bottom circumference designed to increase the bag's capacity. You have indicated that the item may also be made of polyester or in a combination with nylon.

The applicable subheading for the duffel style travel bag of nylon, polyester or a combination of both will be 4202.92.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate for items from Korea will be 19.8 percent ad valorem. The duty rate for items from Vietnam will be 65 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the luggage, backpack, handbags, etc. Your request for a classification ruling should include an exact sample of the items as being imported and a breakdown of component materials by weight of each.

Items classifiable under 4202.92.3030 fall within textile category designation 670. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
