RE: The tariff classification of elastic, braided and linen cords from Taiwan.

Dear Mr. Wood:

In your letter dated October 13, 1995, on behalf of Hobby Lobby Stores Inc., you requested a classification ruling.

You have submitted four samples of textile cords as follows: (A) Lame cord, (B) Waxed linen twine, (C) Metallic elastic cord and (D) Black elastic cord. No style numbers are indicated in your letter. Item (A), the lame cord, is a decorative silver metallic braid with a core of filament yarns. It is not a (twisted) two-ply yarn as indicated in your letter. Item (B) is a four-ply twisted flax twine with a wax coating. We calculate its decitex to be approximately 4700. Items (C) and (D) are both textile-covered, braided elastic cords containing cores of rubber threads which are 70%, by weight; and outer covering of 30% silver metallic strip braid in item (C) and outer covering of 30% Tetoron polyester braid in item (D). We assume that all four items will be imported in continuous lengths. The cords will be used for beading work in the U.S. As requested in you letter, the samples will be returned to you.

The applicable subheading for the two elastic cords, (C) and (D), will be 5604.10.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for rubber thread and cord, textile covered. The duty rate will be 7.1 percent ad valorem.

Item (A), the lame cord, will be classifiable under the provision for braids in the piece, other, other, in subheading 5808.10.9000, HTS. The rate of duty will be 8 percent ad valorem.

The waxed linen cord, (B), will be classifiable under the provision for twine, cordage, ropes and cables, whether or not plaited or braided and whether or not impregnated, coated, covered or sheathed with rubber or plastics; other;; other, in subheading 5607.90.2000, HTS. The rate of duty will be 7.1 percent ad valorem.

The flax twine and rubber threads, items (B), (C) and (D), fall within textile category designation 201. Based upon international textile trade agreements, products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
