RE: Classification of women's blouses from Hong Kong

Dear Ms. Han:

In your letter dated June 19, 1995, you requested a classification ruling on behalf of your client, Transcorp Apparel, Ltd. The samples submitted with your request will be returned to you under separate cover.

Style 7060 is a blouse. The front panels are constructed from 65 percent polyester/35 percent rayon woven fabric. The collar, sleeves, and back panel are constructed from 100 percent cotton woven fabric. The garment features a collar, long sleeves with button cuffs and a full front opening secured by six buttons. The essential character of this garment is imparted by the front panels consisting of 65 percent polyester/35 percent rayon woven fabric.

Style 9097 is an blouse composed of knit and woven components. The garment front, back yoke, collar and cuffs are constructed from 100 percent cotton woven fabric. The sleeves and lower back panel are constructed from 100 percent acrylic knitted fabric. The garment features a collar, long sleeves with cuffs and a zippered full front opening. The garment also has a chest pocket, two four inch side vents and a straight hemmed bottom. The essential character of this garment is imparted by the front panels consisting of 100 percent cotton woven fabric.

The applicable subheading for style 7060 will be 6206.40.3010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' blouses, shirts and shirt-blouses: of man-made fibers: with two or more colors in the warp and\or the filling: women's. The duty rate will be 28.4 percent ad valorem.

The applicable subheading for style 9097 will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for womens' or girls' blouses, shirts and shirt-blouses: of cotton: other: other: women's. The duty rate will be 16.3 percent ad valorem.

Style 7060 falls within textile category designation 641 and style 9097 falls within textile category 341. Based upon international textile trade agreements products of Hong Kong are subject to a visa requirement and quota restraints.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
