RE: The tariff classification of women's knit/woven dresses from Mexico

Dear Mr. Bhatia:

In your letter dated January 30, 1995, you requested a tariff classification ruling.

The submitted samples, styles 814359U, 815619U and 814636U are women's dresses constructed from knit and woven fabrics. The knitted bodice portion does not extend to the waist on any of the three garments. The samples will be returned to you as requested. Style 814639U is a knee length dress constructed from a knit top portion of 50 percent polyester and 50 percent cotton and a woven bottom of 79 percent acetate and 21 percent rayon. The pullover dress features short sleeves, a scooped neckline; two front patch pockets on the skirt portion; and a hemmed bottom.

Style 815619U is a knee length dress constructed from a knit top portion of 100 percent cotton and a woven bottom of 79 percent acetate and 21 percent rayon. The pullover dress features short sleeves, a round neckline, a four button placket and a hemmed bottom.

Style 814639U is a calf length dress and is constructed from a knit top portion of 100 percent cotton and a woven bottoom of 79 percent acetate and 21 percent rayon. The pullover dress features short sleeves, a round neckline, a seven button front opening secured by fabric loops and a hemmed bottom.

With your letter you submitted the following information:

The essential character of all three styles is imparted by the woven portion. The applicable subheading for all styles will be 6204.44.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' suits, ensembles, suit-type jackets and blazers, dresses, ... Of artificial fibers: Other: Women's. The general rate of duty will be 16.9 percent ad valorem.

Textile merchandise which does not qualify as "originating" under the North American Free Trade Agreement (NAFTA), but which has been processed or further produced in Mexico and exported from that country, may be subject to quantitative export or import limitations based upon international trade agreements. The merchandise described in this ruling falls within textile category designation 636.

Since quota and visa restrictions are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
