RE: The tariff classification of glazed ceramic tiles from Brazil.

Dear Mr. Rappold:

In your letter received in this office on January 31, 1995, you requested a tariff classification ruling.

The merchandise at issue consists of glazed ceramic floor and wall tiles which range in size from 2.76 inches by 2.76 inches to 15.2 inches by 15.2 inches.

You inquire as to whether this merchandise is properly classified under subheading 6908.10.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for other glazed ceramic flags and paving, hearth or wall tiles...the largest area of which is capable of being enclosed in a square the side of which is less than 7 cm and the largest surface area of which is less than 38.7 cm square. However, since the dimensions of these subject tiles exceed the parameters of the sizes contained within subheading 6908.10.2000, HTS, consideration of classification under this subheading is precluded.

The applicable subheading for these glazed ceramic floor and wall tiles will be 6908.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other glazed ceramic flags and paving, hearth or wall tiles. The rate of duty will be 18 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
