RE: The tariff classification of a "Personal Glass Fermentor" from Italy.

Dear Mr. Dessureault:

In your letter dated January 17, 1995, you requested a tariff classification ruling.

You have submitted photographs and a detailed description of a product you describe as a "Personal Glass Fermentor". The glass fermentor is equipped with a PVC tap and accessories which will be used to manufacture wine or beer for home consumption.

The 23 litre glass vessel is the largest, most valuable, and most marketable component of the article. The glass vessel represents the essential character of the merchandise.

The applicable subheading for the "Personal Glass Fermentor" will be 7013.39.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table or kitchen purposes... other: other: other: valued over $5 each. The general rate of duty will be 7.2 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
