RE: Static Conductive Brush

Dear Mr. McKeown:

This is in response to your letter of April 30, 1992, on behalf of Hunt Data Products, Inc., to the District Director of Customs in Laredo, Texas, concerning the classification of the MediaMate Anti-Static Brush under the Harmonized Tariff Schedule of the United States (HTSUS). Your letter and the sample brush were referred to this office for a direct response to you. A separate ruling will be issued to you under HQ 556747 as to the applicability of subheading 9802.00.80, HTSUS, to this article.

FACTS:

The merchandise, identified as the MediaMate Anti-Static Brush, is intended to be used to discharge static electricity from computer display screens in a safe manner. The merchandise consists of a conductive brush connected to the grounding source by an insulated wire and grounding clip.

The brush handle is made of plastic and measures approximately 4 inches wide, 2 inches high and 1/2 inch thick. The handle has an elliptical groove in order to facilitate grasping and a Velcro dot on one side for attachment to another Velcro dot to be placed on one side of the computer monitor. The 2 inch long bristles are made from horsehair with 20 percent static conductive nylon. A 6 foot coiled grounding cord attaches the brush to an alligator clip for connection to a ground screen on the back of the computer monitor.

ISSUE:

What is the proper classification under the HTSUS for the Anti-Static Brush?

LAW AND ANALYSIS:

Classification of merchandise under the HTSUS is in accordance with the General Rules of Interpretation (GRI's), taken in order. GRI 1 provides that classification shall be determined according to the terms of the headings and any relative section or chapter notes.

Brushes are provided for under heading 9603, HTSUS. The Anti-Static Brush is classifiable under subheading 9603.90.80, HTSUS, which provides for: "[b]rooms, brushes (including brushes constituting parts of machines, appliances or vehicles). . . [o]ther . . .[o]ther".

HOLDING:

The Anti-Static Brush is classifiable under subheading 9603.90.80, HTSUS, which provides for: "[b]rooms, brushes (including brushes constituting parts of machines, appliances or vehicles). . .[o]ther. . .[o]ther". The general, column one rate of duty is 5.6 percent ad valorem.
