RE: The tariff classification of a heart rate monitor from Japan

Dear Ms. Hashimoto:

In your letter dated April 1, 1994, you requested a tariff classification ruling on behalf of Performance Inc.

The HR-20 HeartRate Monitor, Cat# 40-5800, consists of a textile chest belt to which two electrodes are attached, a small radio transmitter which snaps onto the chest belt, and a radio receiver/display unit which is worn on the wrist and looks like a digital watch. An instruction manual and two batteries, one for the transmitter and one for the receiver, will be imported in the box with the unit. In addition to various heart rate monitoring functions, the unit also serves as an alarm clock, a stopwatch, and a lap timer.

The applicable subheading for the unit will be 9029.20.40, Harmonized Tariff Schedule of the United States (HTS), which provides for other speedometers. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
