RE: The tariff classification of an outdoor switchgear from the United Kingdom

Dear Mr. Kebler:

In your letter dated July 12, 1995 you requested a tariff classification ruling.

As indicated in the submitted descriptive literature, this outdoor switchgear is designated as an "SF 6 Rotating Arc, 36KV Outdoor Circuit Breaker". It is intended for use in conjunction with high tension circuits and protects personnel from the dangers of arc fault, or short circuits. Its special design uses sulphur hexafluoride (SF6) gas as an insulant, as well as the extinguishing medium that serves to break the circuit when necessary.

The applicable subheading for the "SF 6 Rotating Arc, 36KV Outdoor Circuit Breaker" will be 8535.30.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for isolating switches and make-and-break switches, for a voltage exceeding 1000 V. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
