RE: The applicability of 9817.00.96 to a Palmtop Talking Computer from New Zealand

Dear Mr. Welch:

In your letter dated July 24, 1995, you requested a tariff classification ruling on behalf of American Printing House for the Blind, Inc., Louisville, KY.

The article to be imported is a palmtop computer with voice capability. It is marketed under the name "Companion 2000". The computer was previously classified under subheading 8471.20.0090, Harmonized Tariff Schedule of the United States (HTS), in New York Ruling 898478 dated June 10, 1994.

Mr. Welch has furnished two statements dated April 27, 1994 and June 20, 1994 from Mr. David A. Manteuffel, an officer of the importing firm, American Printing House for the Blind and a statement dated August 5, 1994 from Mr. Michael R. Petterson, a manager for the manufacturer, Pulsedata International Limited, Christchurch, New Zealand. According to these statements, the Companion 2000 palmtop computer with the special software is designed for the use of the blind and visually impaired. It includes such features as an electronic book reading program, and voice prompts and help messages to support the various other programs. The computer is not sold without the special software installed and is manufactured exclusively for the American Printing House for the Blind for distribution to blind or visually impaired school children.

Based on the above, the Companion 2000 palmtop computer would be eligible for free entry under the provision for articles specially designed or adapted for the use or benefit of the blind or other physically or mentally handicapped persons... other, in subheading 9817.00.96, HTS. All applicable entry requirements must be met including the filing of form ITA-362P.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
