RE: The tariff classification of Gillette Razor Blade Cartridges from Brazil

Dear Ms. Clifford:

In your letter dated November 23, 1994, received December 2 by this office, you requested a tariff classification ruling on behalf of L & M Impex, New York, NY.

The articles to be imported are Gillette razor blade cartridges manufactured in the United States and shipped to South America. These will now be bought from a distributor in Brazil and brought back to the United States. The cartridges are packed five to a sealed box on a display hanger card. The product description and specifications on the box are in Spanish but the box is clearly marked "Made in U.S.A." on the front.

You inquired as to whether the Spanish markings would hinder the clearance of the cartridges through Customs as American goods. We are of the opinion that the spanish markings on the product would not preclude its being classified as American goods returned.

The applicable subheading for the Gillette razor blade cartridges will be 9801.00.1082, Harmonized Tariff Schedule of the United States (HTS), which provides for products of the United States when returned after having been exported, without having been advanced in value or improved in condition by any process of manufacture or other means while abroad... other. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
