RE: The tariff classification of tarpaulins from China and the Philippines.

Dear Mr. Ye:

In your letter dated February 16, 1994, you requested a tariff classification ruling.

A sample was submitted with your letter. The tarpaulin consists of polyethylene strips woven into a fabric coated on both sides with a visible plastics material. Each of the polyethylene strips are under 5 mm in width. The tarpaulin has grommets. The sample you submitted is blue, though you state that the tarpaulins will be imported in a variety of colors. This ruling applies only to those tarpaulins, which like the sample, are blue.

The applicable subheading for the tarpaulin will be 3926.90.9590, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem.

Articles classifiable under subheading 3926.90.9590, HTS, which are products of the Philippines, are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
