RE: The tariff classification of women's wearing apparel from China and Hong Kong

Dear Mr. Adams:

In your letter received in this office on February 15, 1994, you requested a tariff classification ruling.

Vendor model KL94-10/Fingerhut Product Code A2062 consists of two pieces constructed from woven fabric that is 55 percent ramie/45 percent cotton. The jacket sleeves are of 100 percent woven polyester. The unlined, double-breasted jacket features a four button closure, padded shoulders, button cuff sheer sleeves, and a collar that is embellished with embroidery and beading. The unlined skirt features a semi-elasticized waistband, a rear zipper and button closure and a center back vent. The embroidery and beading is repeated on the front waistband.

Vendor model KL94-16/Fingerhut Product Code A2039 consists of two pieces. The duster is constructed from fabric that is 100 percent woven nylon. The sheer duster features 3/4 length sleeves with cuffs, an unsecured full front opening, 13 inch side slits and ribbon and rhinestone trim on the front panels. The garment extends below the knee. The jumpsuit is constructed from fabric that is 65 percent polyester/35 percent cotton knit. The sleeveless jumpsuit features one inch shoulder straps, a rhinestone design on the bodice, and elasticized waist and a 16 inch back zipper. The jumpsuit has straight legs with side seam pockets.

As requested, your samples will be returned to you.

The applicable subheading for the jacket of KL94-10/A2062 will be 6204.39.8060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts,
trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of other textile materials: other: other: other. The rate of duty will be 6.7 percent ad valorem.

The applicable subheading for the skirt of KL94-10/A2062 will be 6204.59.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' suits, ensembles, suit- type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): skirts and divided skirts: of other textile materials: other... other: other. The rate of duty will be 7.2 percent ad valorem.

The applicable subheading for the duster of KL94-16/A2039 will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': of man-made fibers...other. The rate of duty will be 17 percent ad valorem.

The applicable subheading for the jumpsuit of KL94-16/A2039 will be 6114.30.3054, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of man-made fibers: other...coveralls, jumpsuits and similar apparel: women's or girls': other. The rate of duty will be 16.1 percent ad valorem.

The jacket falls within textile category designation 835 and the skirt within 842. The duster falls within textile category 659 and the jumpsuit 659 within. Based upon international textile trade agreements, products of China and Hong Kong are subject to a visa requirement. Products from China are subject to quota restraints.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
