RE: The tariff classification of men's knit garments from Canada.

Dear Ms. Sugar:

In your letter dated January 19, 1994, you requested a tariff classification ruling on behalf of Sky Knitting (1991) Limited.

Style A-340 is a man's vest constructed from 100 percent acrylic, interlock knit fabric which measures 19 stitches per 2 centimeters counted in the horizontal direction. The garment is sleeveless and features a V-shaped neckline; oversized armholes; and a rib knit bottom.

Style A-240 H is a man's sweater constructed from 100 percent acrylic, jersey knit fabric which measures 7 stitches per 2 centimeters counted in the horizontal direction. The garment features a V-shaped neckline; long sleeves with rib knit cuffs; and a rib knit bottom.

Style C-240 J is a man's sweater constructed from 100 percent cotton, jersey knit fabric with a needle out pattern. The fabric measures 8 stitches per 2 centimeters counted in the horizontal direction. The garment features a crew neckline; long sleeves with rib knit cuffs; and a rib knit bottom.

Style G-540 is a man's golf shirt constructed from 65 percent polyester, 35 percent cotton, jersey knit fabric which measures more than 10 stitches per linear centimeter counted in both the horizontal and vertical directions. The garment features a banded, point collar; a partial front opening with four button closures; short, hemmed sleeves; a patch pocket on the right chest; and a hemmed bottom.

Style W-200 is a man's sweater constructed from 70 percent acrylic, 30 percent wool, all-over 2x2 rib knit fabric which measures 8 stitches per 2 centimeters counted in the horizontal direction. The garment features a V-shaped neckline; long sleeves; woven fabric patches on the elbows and on the shoulders; and woven fabric epaulets which are secured by fasteners similar to the VELCRO brand hook and loop fastener.

As requested, your samples will be returned.

The applicable tariff provision for Style A-340 will be 6110.30.3030, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: vests, other than sweater vests: men's or boys'. The general rate of duty will be 34.2 percent ad valorem.

The applicable tariff provision for Style A-240 H will be 6110.30.3010, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: sweaters: men's or boys'. The general rate of duty will be 34.2 percent ad valorem.

The applicable tariff provision for Style C-240 J will be 6110.20.2010, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: sweaters: men's. The general rate of duty will be 20.7 percent ad valorem.

The applicable tariff provision for Style G-540 will be 6105.20.2010, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for: men's or boys' shirts, knitted or crocheted: other: of man-made fibers: men's. The general rate of duty will be 34.6 percent ad valorem.

The applicable tariff provision for Style W-200 will be 6110.30.1510, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: containing 23 percent or more by weight of wool or fine animal hair: sweaters: men's or boys'. The general rate of duty will be 17 percent ad valorem.

Textile merchandise which does not qualify as "originating" under the North American Free Trade Agreement (NAFTA), but which has been processed or further produced in Canada and exported from that country, may be subject to quantitative export or import limitations based upon international trade agreements. The merchandise described in this ruling falls within the following textile category designations: Style A-340 - Category 659; Style A- 240 H - Category 645; Style C-240 J - Category 345; Style G-540 - Category 638; Style W-200 - Category 445.

Since quota and visa restrictions are the result of interna- tional bilateral agreements which are subject to frequent renego- tiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have already been filed, this ruling should be brought to the attention of the Customs officer handling the transaction.
