RE: Admissibility of Balisong Knives from the Philippines

Dear Mr. Aquino:

In your letter dated November 11, 1993, you requested a ruling on tariff classification and admissibility of Balisong knives from the Philippines.
You submitted five sample knives. Two of the knives have 4 1/4-inch blades and measure 4 3/4 inches in the closed position. Two other knives have 5 1/4-inch blades and measure 5 3/4 inches in the closed position. The fifth knife has a 15 3/4-inch blade and measures 16 1/2 inches in the closed position.

Pursuant to the Switchblade Knife Act (15 U.S.C. 1241-1244), Customs Regulations 12.95-12.103 and Customs Headquarters' Telex of 9-29-88, these Balisong knives are prohibited merchandise and cannot be imported into the United States. Consequently, we are precluded from returning to you the five samples of Balisong knives as requested. They will be destroyed 30 days after the date of this letter.

Sincerely,

Jean F. Maguire
Area Director
